Here's the thing. If the DOJ finds cause to prosecute, fine. I don't think Congress has a hand to play in any "investigation" because it would turn out to be partisan.
But Rush presents a whole lot more to the Dems. He's a wedge issue, however false. True, he's got a loyal following, but that's made up of hardcore neocons. It's great theater to put the Bush administration on trial, while hinting that the GOP is moving back in that direction. Some people are scared of liberal socialism; others are scared of conservative fascism. Right now, Obama enjoys approval ratings that seem to put him, again, above the fray.
And yes, the commercial is completely out of context. And I listen to Rush, more often than I should probably. But I refuse to back him after the "phony soldier" comment. Sometimes he does cross a line for ratings.

A loud minority's effect on relative tranquility is a consequence that a news organization has to consider. Remember, Murdoch is in it to make money. And at the end of the day, the need to make a buck trumps any moral conviction that Murdoch may have had.
Like it or not, the opinion of that minority is echoed by a large portion of the population. Enough to make the head of a huge corporation take the stand and tell them what they wanted to hear. And that's democracy and capitalism working together to shape the world.
